- How much do they cost? Many people are unaware that Trustee
Companies although initially do not charge for the preparation of
a Will, have themselves appointed as Executors of the Will and accordingly,
are able to claim commission on the Estate of the deceased. For
example, on an estate worth $1million, the commission could be as
high as $30,000 which of course can sometimes cause financial hardship
for the beneficiaries of the deceased.

Do
I need a Power of Attorney?
It has also become increasingly important that people have in place
an Enduring Power of Attorney so that in the event of sickness,
travel or other incapacity, their private and business affairs are
capable of being properly attended to.
Unfortunately, in some instances where such Power of Attorney does
not exist, it becomes necessary for the Office of the Protective
Commissioner to assume control of a person's affairs which can create
difficulty for business partners and families.
The cost of having an Enduring Power of Attorney prepared and executed
is comparatively inexpensive at $250 plus GST. |

Probate
and Deceased Estates
People are aware that in many cases when a person dies it is necessary
to obtain a Grant of Probate to enable the property to be distributed
in accordance with the Will.
The State of New South Wales has certain probate filing fees which
must be paid and there is also a set scale of fees charge depending
on the value of the estate.
It is important to obtain proper quotations from your Solicitor
as cost can be quite high.
